1. Acceptance of Terms

By accessing or using recyclemydrive.com (the “Website” or “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the Service.

2. The Service

recyclemydrive.com operates a platform that purchases used but functional elevator drives and industrial drives (“Drives”) from individuals and businesses. We evaluate submitted Drives, make purchase offers, and, upon acceptance and successful inspection, buy the Drives for refurbishment, recycling, or resale.

3. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering binding contracts. To sell Drives to us, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account and for all activity under it.

4. Selling Process

4.1 You may submit Drives for sale by uploading photos, descriptions, serial numbers, and other requested information.

4.2 We review submissions and may extend a purchase offer. Offers are non-binding until we accept the shipment and complete our inspection.

4.3 If you accept our offer, you must ship the Drive(s) to the address we provide (shipping instructions and any prepaid label will be supplied).

4.4 We reserve the right to inspect all received Drives. We may reject any Drive that does not match the submitted description, is not functional, or fails our quality standards. In case of rejection, we will notify you and return the Drive at our expense or dispose of it in accordance with applicable law (you will not receive payment).

5. Seller Representations and Warranties

By submitting any Drive for sale or accepting a purchase offer, you expressly represent and warrant that:

  • a) You are the sole legal owner of the Drive(s) and have full authority to sell them to us;
  • b) The Drive(s) are free and clear of any liens, security interests, claims, encumbrances, leases, or third-party rights;
  • c) The Drive(s) are not stolen, counterfeit, or obtained through fraud or illegal means;
  • d) Selling the Drive(s) does not violate any applicable law, regulation, or agreement you have with any third party (including your employer, landlord, or financing company);
  • e) You have the right to transfer full legal title to us upon our acceptance and payment;
  • f) All descriptions and information you provide are true, accurate, and complete.

BREACH OF ANY OF THE ABOVE MAY RESULT IN IMMEDIATE REJECTION OF THE SALE, NON-PAYMENT, AND POTENTIAL LEGAL ACTION AGAINST YOU, INCLUDING INDEMNIFICATION FOR ANY LOSSES WE SUFFER.

6. Payment

Upon successful inspection and acceptance, we will pay you the agreed amount via the method specified at the time of offer (e.g., bank transfer, PayPal). Payment is normally issued within 3 business days of acceptance. You are responsible for any taxes, duties, or fees on the sale.

7. Shipping and Risk of Loss

You bear all risk of loss or damage until we receive and accept the shipment. We are not liable for shipments lost or damaged in transit.

8. No Warranties on Our Part

The Service is provided “as is.” We make no warranties regarding the Website’s availability, accuracy of offers, or the ultimate resale/refurbishment value of purchased Drives.

9. Prohibited Conduct

You may not: submit false information, attempt to sell items you do not own, engage in fraudulent activity, or use the Service for any unlawful purpose.

10. Intellectual Property

All content on the Website is our property. You grant us a perpetual, royalty-free license to use any photos or descriptions you submit for our business purposes.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid to you for the specific Drive in question.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your breach of the Seller Representations and Warranties in Section 5 or any violation of these Terms.

13. Governing Law

These Terms shall be governed by the laws of the United Kingdom, without regard to conflict of laws principles. Disputes shall be resolved exclusively in the courts located in the United Kingdom.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
